ARTICLE 1 - GENERAL

These General Sales Conditions (GSC) apply, without restriction or reserve, to all services offered by the certified practitioner Patricia LE THIEC, an individual enterprise hereinafter referred to as Fleur de massage, registered under the SIRET number 979 777 265 00013, and to all its clients, regardless of their status or quality. Consequently, placing an order by a client for a proposed service, either on the website: https://www.rdv360.com/fleur-de-massage-72500-beaumont-pied-de-boeuf, or by phone at 06.46.75.54.81, or by email: fleur.d.massage@gmail.com, implies the adherence of the latter and acceptance, without reservation, to these GSC, unless a specific agreement has been previously agreed in writing between the parties. Fleur de massage reserves the right to modify these GSC at any time. The GSC applicable to an order are those in effect at the time of placing the order. In case of modification, the modified GSC will only apply to orders placed after the modification and not to previous orders. Any document other than these GSC (including advertisements, brochures, flyers, etc.) has only informative value about the activity offered by Fleur de massage and is not contractual.

ARTICLE 2 - DEFINITIONS

The services offered are those listed on the Fleur de massage website (https://patriciale-thiec.wixsite.com/fleurdemassage) and on the online booking site (https://www.rdv360.com/fleur-de-massage-72500-beaumont-pied-de-boeuf), namely:

Well-being massage services per session or as a package
Gift cards for these same well-being massage services
Reservation for these well-being massage services

The client is the person who books a well-being massage session or purchases a gift card from Fleur de massage. The beneficiary is the person who receives a gift card from Fleur de massage.

ARTICLE 3 - CONDITIONS FOR SERVICE EXECUTION

The purpose of Fleur de massage's activity, conducted by Patricia Le Thiec, is exclusively the well-being of the person. In accordance with current legislation, well-being massages practiced by Patricia Le Thiec, in the absence of diagnosis and therapeutic treatment, do not resemble, neither in content nor in purpose, the practice of Physiotherapy, as well as any medical practice. These are solely manual techniques for well-being and relaxation. Also excluded from Fleur de massage's activity are any services of an erotic or sexual nature. At a minimum, the use of disposable underwear is mandatory; no nude massage will be performed. Any inappropriate behavior towards Patricia Le Thiec will be subject to legal proceedings. Fleur de massage only intervenes by appointment, traveling within a radius of 30km from Beaumont-Pied-de-Bœuf to the client's home, in a professional environment, or in any place open to the public (event venues, fairs, conferences, etc.) upon acceptance of a quote by the client. In this case, the client undertakes to provide Fleur de massage with a space (minimum 10 m²) with hygiene, calm, and safety conditions compatible with the realization of a massage. The services are offered according to the hours indicated on the "Home" page of the website https://patriciale-thiec.wixsite.com/fleurdemassage. Fleur de massage reserves the right to modify the hours at any time. During well-being massage sessions, Fleur de massage provides the client with all the necessary professional equipment (massage table, protective linen, towels, massage oils, accompanying music, etc.) and reserves the right to refuse a well-being massage session in case of questionable hygiene on the part of the client and/or inappropriate behavior. The session begins with an exchange between Patricia Le Thiec and the client, allowing an assessment of the client's condition and needs to determine the most suitable massage. Time will be given to the client to settle in. The client's comfort and privacy will be ensured by a set of sheets and towels. At the end of the massage, time will be given to the client to regain consciousness and dress. A review will be made of the mutual feelings, and some advice will be given. The sessions include handling, setup, massage, and end exchange. Fleur de massage refrains from operating in conditions, states, or places that could compromise the quality of its services and the dignity of the practice of Well-being Massage. As a precautionary principle, Fleur de massage may refuse to perform the services in the event of a medical contraindication to massage. Patricia Le Thiec undertakes to respect the basic rules of personal and clothing hygiene so as not to cause any inconvenience.

ARTICLE 4 - FINANCIAL CONDITIONS

The prices of the services offered are indicated in euros on the website: https://patriciale-thiec.wixsite.com/fleurdemassage and the online booking site: https://www.rdv360.com/fleur-de-massage-72500-beaumont-pied-de-boeuf. The prices are firm and final, excluding promotional actions. The displayed price of a massage corresponds, excluding tax, to 75% for the service performed by Patricia Le Thiec, 15% for the fuel price for transportation, and 10% for the sale of massage oil. The massage oil purchased by the client for each service is used by Patricia Le Thiec during the massage, unless explicitly indicated otherwise by the client when booking. Fleur de massage is subject to Value Added Tax (VAT), and the prices mentioned on the websites are expressed in euros and inclusive of VAT. Fleur de massage also reserves the right to modify its prices at any time, with the understanding that the services will be invoiced based on the prices in effect at the time of booking the appointment or purchasing the gift card.

ARTICLE 5 - APPOINTMENT SCHEDULING PROCEDURES

5.1. Appointment Scheduling

Appointments are scheduled on the website (https://www.rdv360.com/fleur-de-massage-72500-beaumont-pied-de-boeuf), by email, or by phone. All the necessary contact information for scheduling appointments is available on the website https://patriciale-thiec.wixsite.com/fleurdemassage, notably through the online booking form. Online booking is only available for home sessions; reservations for businesses are made by email or phone. To book online, the reservation form is to be completed step by step. The client chooses the desired service, as well as availability. Based on the defined criteria, time slots will be suggested. If the slots are grayed out, it means they are no longer available. The client finalizes the reservation by providing their contact information. Patricia Le Thiec only travels from one hour of appointment, which is two consecutive 30-minute appointments or one session of one hour or more. The reservation will be considered validated only upon receipt of the validation email sent by the email address fleur.d.massage@gmail.com. In order to organize Patricia Le Thiec's schedule, online booking is open up to 24 hours before the massage time.

5.2. Conditions for Modification and Cancellation of a Session

The client has the possibility to modify or cancel their reservation for free up to 3 hours before the appointment on the website: https://www.rdv360.com/fleur-de-massage, and within 3 hours by phone.

5.3. Payment

For reservations, the total payment for the session is made at the beginning of the session in cash, by check, or by credit card.

ARTICLE 6 - PURCHASE OF GIFT CARDS

6.1. Purchase of Gift Vouchers

The purchase of gift vouchers is made on the website: https://www.rdv360.com/fleur-de-massage-72500-beaumont-pied-de-boeuf. A gift card in PDF format or paper will be sent to the client. Payment can be made in cash, by check, by credit card, or by bank transfer. The purchase of gift vouchers on the website is available 24/7. To order, the client chooses the gift voucher they want to offer and completes the purchase. They will receive an email from Patricia Le Thiec indicating the voucher number and asking for the beneficiary's name. The purchase of the gift voucher is only validated after payment and providing the beneficiary's name. PDF format gift vouchers are sent within a maximum of 24 hours to the email address provided during the order. A withdrawal period of 14 working days from the receipt of the client's payment is provided without justification or penalty. Fleur de massage will refund the amounts paid by the client within a maximum period of thirty days from the receipt of the refund request.

6.2. Gift Card Modalities

All gift vouchers are nominative and non-transferable. Unless otherwise stated, gift vouchers are valid for one year from the date of purchase. They are not refundable or extendable unless Patricia Le Thiec cannot provide the service or for medical reasons (with justification). Reservations are made by email or phone. The modification or cancellation conditions for a reservation are the same as those defined in Article 6 of these GSC.

ARTICLE 7 - PREFERRED RATES

Reductions granted as part of advertising apply to the normal rate and not to the current promotional rate. They are valid according to the conditions of the established offers.

ARTICLE 8 - SERVICES REQUIRING A CUSTOMIZED QUOTE (companies, events)

The quote is valid for 30 (thirty) days from the date of issue. The signed quote and GSC by the client are considered an agreement and purchase order. The signed quote and GSC must be accompanied by a payment of 30 (thirty) % of the total amount indicated on the quote. This deposit payment will be made by check or bank transfer. Unless additional payment terms agreed upon by mutual agreement and indicated on the invoice, the balance of the payment is made in cash within a maximum period of 7 (seven) working days following the date of issue of the invoice, by check or bank transfer. In case of late payment, a penalty of 15 (fifteen) % of the invoice amount, per month of delay started, is due without the need for a reminder, from the day following the payment deadline. Any request for postponement or cancellation by the client must reach Fleur de massage at least 7 (seven) working days before the set date. Otherwise, Fleur de massage will be entitled to charge, as compensation, 50 (fifty) % of the total amount of the invoice, before deduction of the deposit received. If the cancellation occurs within 3 (three) working days before the set date, Fleur de massage will be entitled to charge, as compensation, 75 (seventy-five) % of the total amount of the invoice, before deduction of the deposit received. In case of on-site or eve-of cancellation, the compensation will be 100 (one hundred) % of the amount of the planned service. In case of cancellation at the initiative of Fleur de massage and if no replacement date is agreed upon, it will reimburse the client the deposit received within a maximum period of 8 (eight) days.

ARTICLE 9 - INCAPACITY TO WORK

In case of temporary physical incapacity, due to illness or accident of Patricia Le Thiec, Fleur de massage reserves the right to schedule new intervention dates in consultation with the client without the latter being able to claim compensation. In case of permanent physical incapacity of the practitioner, any type of contract or commitment with Fleur de massage's clients will be automatically terminated without Fleur de massage being required to pay compensatory damages. The deposits received will be refunded to the client within a maximum period of 8 (eight) days following the contract termination.

ARTICLE 10 - APPLICABLE LAW AND COMPETENT JURISDICTION

These GSC are subject to French law. In case of disputes, the parties undertake to seek an amicable solution before any legal action. In case of failure, any dispute arising with a client will be submitted to the exclusive jurisdiction of the courts.
